Basic terms

Within the meaning of these sales terms, a buyer is a natural or legal person who orders at least one product via the website https://carmodelsshop.com/
, fills in the required information, and pays for the ordered product.

If the buyer’s information contains details of a legal entity, the buyer shall be considered the legal entity, and the natural person whose data has been entered shall be considered the authorized representative of the buyer.

Car Models Shop j.d.o.o. undertakes to use your personal data solely for identification purposes when using the online store, in order to enable you to use all the options it provides, and to keep them confidential, i.e. it will not distribute, publish, provide them to third parties for use, nor make them available in any other way to any third party without your prior consent.

Statement on the protection, collection, and use of personal data

Car Models Shop j.d.o.o. undertakes to protect customers’ personal data by collecting only the necessary, basic data about customers/users that are required to fulfill our obligations; informing customers about the manner in which collected data are used; and regularly providing customers with the option to choose how their data are used, including the possibility to decide whether or not their name should be removed from lists used for marketing campaigns. All user data are strictly protected and available only to employees who require such data to perform their duties. All employees of Car Models Shop j.d.o.o. and its business partners are responsible for respecting the principles of privacy protection.

Electronic communication

By visiting the pages of our online store, you communicate electronically. By doing so, you accept that all agreements, notices, announcements, and other content delivered to you electronically satisfy legal requirements as if they were provided in written form.

Price

Car Models Shop j.d.o.o. undertakes to clearly, visibly, and legibly display the retail price amount in accordance with Article 7 of the Consumer Protection Act (Official Gazette NN 41/14).

Car Models Shop j.d.o.o. will periodically, at its own discretion, offer certain products for sale at a promotional price lower than the regular retail price and undertakes to clearly and visibly mark such promotions and state their duration.

After the expiration of the promotional period, Car Models Shop j.d.o.o. will not accept orders under the terms applicable to the expired promotion.

Product availability

Due to a large number of orders being placed simultaneously on https://carmodelsshop.com/
, it may occur that product availability information does not correspond to actual warehouse stock levels.

If the ordered product is not available in stock, Car Models Shop j.d.o.o. will inform the customer that the product is currently unavailable, the timeframe in which it can be supplied, and will also offer the option to purchase an alternative product from https://carmodelsshop.com/
that is available for delivery and is most similar in characteristics to the product that cannot be delivered.

For magazine models: cardboard or plastic packaging may be damaged, and the base or acrylic cover may also be damaged.

Order and moment of contract conclusion

Products are ordered by selecting items, using the menu, and completing the electronic order form. The customer may order and purchase products as a registered or unregistered user. A product is considered ordered once the customer has completed the entire ordering process. Payment for ordered products can be made in the following ways:

Bank transfer / Payment slip / e-banking

At the moment the order is received, Car Models Shop j.d.o.o. will notify the customer electronically via email that the order has been received, i.e. that the product has been successfully ordered. If you do not receive the notification mentioned above, it is recommended to check:

Whether the message is located in the Junk/Spam folder
Whether the mailbox is full
Whether the items are in the shopping cart; if not, the ordering process should be repeated

After the shipment has been handed over to the delivery service, the customer will be notified via email that the shipment has been dispatched. In the case of payment via e-banking or bank transfer, the contract is considered concluded at the moment Car Models Shop j.d.o.o. receives confirmation that the order amount has been paid. If a product is ordered and e-banking or bank transfer is selected as the payment method, Car Models Shop j.d.o.o. undertakes to reserve the product in stock for a period of 3 working days, excluding Saturdays. After the expiration of 3 working days from the receipt of the order, Car Models Shop j.d.o.o. does not guarantee product availability. Delivery costs are not included in the product price. Delivery costs are listed under the DELIVERY link in the main menu at the top of the website. Delivery is carried out to all countries listed in the price list. For other countries, you may send an inquiry to the email address . All shipments are insured by the delivery service DPD up to a shipment value of €520. Information about delivery conditions and shipment tracking is available at https://www.dpd.com/hr/hr/primanje-paketa/parcel-tracking/. If e-banking or bank transfer is selected as the payment method and Car Models Shop j.d.o.o. does not have the ordered product available due to insufficient stock, the customer will be notified within a reasonable period, and Car Models Shop j.d.o.o. will, in agreement with the customer, refund the paid amount. In the case of the above-mentioned payment methods, the customer is responsible for and bears the risk related to the accuracy and correctness of the provided data, as Car Models Shop j.d.o.o. will process the refund in accordance with the data supplied.

Statement on the security of online payments

When making payments in our online store, you use CorvusPay – an advanced system for secure acceptance of payment cards over the Internet.
The CorvusPay system ensures complete confidentiality of your card and personal data from the moment you enter them into the CorvusPay payment form. Payment data is transmitted in encrypted form from your web browser to the bank that issued your card. Our store never comes into contact with complete payment card details. Likewise, the data is inaccessible even to employees of the CorvusPay system. An isolated core independently transmits and manages sensitive data, keeping them completely secure at all times.

The payment data entry form is secured with SSL transport encryption of the highest reliability. All stored data is additionally protected by encryption using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. CorvusPay meets all security requirements for online payments prescribed by leading card brands and operates in accordance with the PCI DSS Level 1 standard – the highest security standard in the payment card industry. When paying with cards included in the 3-D Secure program, your bank additionally confirms your identity, in addition to the validity of the card itself, using a token or password.

CorvusPay considers all collected information confidential and treats it accordingly. The information is used exclusively for the purposes for which it was intended. Your sensitive data is fully secure, and its privacy is guaranteed by the most modern protection mechanisms. Only data necessary for conducting business in accordance with the prescribed and demanding procedures for online payments are collected.

Security controls and operational procedures applied to our infrastructure ensure the continuous reliability of the CorvusPay system. In addition, by maintaining strict access control, regular security monitoring, in-depth checks to prevent network vulnerabilities, and the planned implementation of information security policies, the level of system security is permanently maintained and enhanced to protect your card data.

Statement on currency conversion

All payments will be made in euros. When charging your credit card, the amount is converted into your local currency according to the exchange rate of your credit card association. As a result of this conversion, there may be a slight difference compared to the original price stated on our website.

Delivery

Products may be ordered for delivery within the territory of the Republic of Croatia and other countries listed in the price list, under the conditions applicable to each delivery area.

Car Models Shop j.d.o.o. undertakes to dispatch the ordered product within:

2–5 working days from receipt of payment and conclusion of the contract for items that are in stock.
For items in PRE-ORDER, delivery is within 15 days unless otherwise stated or unless an Expected Delivery Time is specified.
25 working days from the date of contract conclusion for items whose delivery time is 15–20 days.
For items ordered as a pre-order, delivery will be within 15–20 working days from the moment Car Models Shop receives notification from the supplier that the goods are available.
The Expected Delivery Time is information provided by the manufacturer and represents an approximate period when the model should be delivered. This delivery time may be shorter or longer depending on when the manufacturer delivers the model.

Delivery is carried out in accordance with the terms and conditions of the delivery service provider and is considered completed at the moment the product is handed over to the delivery service.

If a product sent to the customer or recipient is returned to Car Models Shop j.d.o.o. because the delivery service was unable to complete the delivery, the customer will be notified by email and will be offered the option of resending the shipment.

Upon receipt of the package, it is mandatory to photograph the box in which the shipment arrived before opening the package.

Unilateral termination of the contract

You may unilaterally terminate the contract within 14 days without stating any reason.

In order to exercise your right to unilaterally terminate this Contract, you must inform us of your decision to terminate the contract before the expiration of the deadline by means of an unequivocal statement sent by email to , stating your first and last name, address, telephone number, fax number, or email address. You may also use the provided model withdrawal form.

We will deliver confirmation of receipt of the notice or the withdrawal form to you without delay by email.

The deadline for unilateral termination is 14 days from the day on which the goods that are the subject of the contract are handed over to you or to a third party designated by you, who is not the carrier.

If you unilaterally terminate this Contract and the goods have not yet been dispatched, we will refund the amount we have received from you, including delivery costs, without delay and no later than 14 days from the day on which we received your decision to terminate the contract, unless you have chosen a type of delivery that is not the least expensive standard delivery option offered by us.

If you unilaterally terminate this Contract and the goods have been dispatched, we will refund the amount we have received from you, including delivery costs, without delay and no later than 14 days from the day we receive the returned goods, which you must send back within 14 days of receipt, unless you have chosen a type of delivery that is not the least expensive standard delivery option offered by us.

The refund will be made using the same means of payment as you used for the original transaction. If you agree to a different method of refund, you will not incur any costs related to the refund.

We may withhold the refund until we have received the goods back or until you have supplied evidence that you have sent the goods back.

You are deemed to have fulfilled your obligation on time if you send or hand over the goods to us, or to a person authorized by us to receive the goods, before the expiration of the aforementioned deadline.

You must bear the direct cost of returning the goods.

You are responsible for any diminished value of the goods resulting from handling other than what was necessary to establish the nature, characteristics, and functioning of the goods.

The consumer does not have the right to unilaterally terminate the contract if:

the subject of the contract is sealed goods that are not suitable for return for health or hygiene reasons, if they were unsealed after delivery
the subject of the contract is perishable goods or goods with a short expiration date

Material defects of products and complaints

IT IS MANDATORY TO PHOTOGRAPH THE OUTER TRANSPORT BOX (FROM ALL SIDES) IN WHICH THE SHIPMENT ARRIVED, AS WELL AS THE PRODUCT BOX, BEFORE OPENING. Without these photos, we cannot acknowledge defects on the product.

If the buyer notices material defects of the delivered product as defined in Article 401 of the Civil Obligations Act, for which the Seller is liable pursuant to Article 400 of the same Act, the buyer may, at their own discretion, in accordance with Article 410 of the same Act:

1) request the seller to remedy the defect,

2) request the seller to deliver another item free from defects,

3) declare termination of the contract (pursuant to Article 412 of the Civil Obligations Act – if the buyer has previously granted the seller an additional reasonable period for contract performance. The buyer may terminate the contract without granting an additional period if the seller, after being notified of the defects, has stated that they will not perform the contract, or if it is evident from the circumstances of the specific case that the seller will not be able to perform the contract even within the additional period, as well as in cases where, due to the seller’s delay, the buyer can no longer achieve the purpose for which the contract was concluded).

Refunds may be processed only after the goods have been returned to us, and no later than 15 days from the receipt of the product.

If the seller fails to perform the contract within the additional period, the contract shall be terminated by operation of law; however, the buyer may maintain the contract in force if they immediately notify the seller that they wish to keep the contract in effect.

The same applies in the case of defective performance of an obligation where performance within a specified period constitutes an essential element of the contract.

The buyer loses the right to terminate the contract due to a defect in the goods if it is impossible for them to return the goods or to return them in the condition in which they were received.

However, the buyer may terminate the contract due to a defect in the goods if the goods have been completely or partially destroyed or damaged due to a defect that justifies termination of the contract, or due to an event not attributable to the buyer or to a person for whom the buyer is responsible.

The same applies if the goods have been completely or partially destroyed or damaged during the buyer’s fulfillment of the obligation to inspect the goods, or if the buyer, before the defect was discovered, consumed or altered a part of the goods during their regular use, provided that such damage or alteration is insignificant.

A buyer who has lost the right to terminate the contract due to the impossibility of returning the goods or returning them in the condition in which they were received retains all other rights granted by law due to the existence of a defect.

After the buyer submits a written notice to the seller by email to and if it is determined that the complaint is justified, Car Models Shop j.d.o.o. will remedy the defect in accordance with an agreement reached with the buyer.

The return of defective products to the seller shall be carried out at the seller’s expense.

All goods sold by us are properly stored in their original packaging.

Jurisdiction and applicable law
In the event of a dispute between the consumer and the trader, a complaint may be submitted to the Court of Honour of the Croatian Chamber of Economy, a proposal for mediation may be submitted to a mediation center, or to the European Commission via the Online Dispute Resolution platform (available on the website: https://ec.europa.eu/consumers/odr/). The aim of Car Models Shop j.d.o.o. is to resolve all disputes amicably. These Terms are in accordance with the laws of the Republic of Croatia, and Croatian law shall apply to all unresolved disputes arising out of or in connection with these General Terms, with the competent court in Zagreb having jurisdiction.
